NRCC Proposes Royalty Rates for Fitness Venues and Dance Venues

NRCC issued a statement today on a proposal for the payment of music royalties by fitness venues and dance venues.

The proposed Tariff 6 (Use of Music to Accompany Dance and Fitness) would provide fair compensation to artists and record companies for the use of their recorded music by fitness venues and dance venues such as nightclubs.

Royalties to be sought from television, movie theatres, webcasters and simulcasters
Released – April 4, 2008

The Neighbouring Rights Collective of Canada (NRCC) this week proposed three new tariffs to the Copyright Board of Canada  for the payment of royalties to recording artists, musicians, and labels when their sound recordings are used in television programs, motion picture theatres, and in non-interactive webcasting or in the simulcasting of traditional radio signals via the Internet. The royalty rates will be established only after examination and certification by the Copyright Board, a process which includes the opportunity for interested parties to file objections and participate in a hearing before the Copyright Board.

“We are pleased to be able to seek these new tariffs on behalf of our members,” says Diana Barry, President of NRCC.  “As with any business, it is crucial to artists and labels to be paid fairly for their work, and royalties, such as those collected by NRCC, are a vital piece of the total mix of payment these creators receive.  Sound recordings contribute so much to audiences’ enjoyment of television, movies and webcasts but so far there has been no payment for the public performance or communication to the public of sound recordings that is inherent in these uses.  These tariffs will change that.”

Tariff No. 3 – Background Music Supply and Background Music Use Tariff (2003-2009) Released – October 20, 2006

Today the Copyright Board of Canada released a decision on royalties to be collected by NRCC for the public performance or the communication to the public by telecommunication, in Canada, of published sound recordings embodying musical works and performer's performances of such works by Background Music Suppliers and Users for the years 2003 to 2009. The Board’s approval of NRCC Tariff 3 will see performers and makers, for the first time in Canada, earn royalties for the use of their sound recordings as “background” in establishments such as a restaurant, bar, office, workplace, place of business, park, hotel, motel, hospital, club, school, showroom, motion picture theatre, sports facility, dance hall, theme park, exhibition or fair, as well as all means of public conveyance, including aircraft, ships, railway trains and buses.

Board Decision 'Reasonable and Worthy of Respect'

NRCC today expressed its disappointment at the reaction of the Canadian Association of Broadcasters (CAB) to the recent decision of the Copyright Board to increase the tariff rates for music use by commercial radio stations in the years 2003-2007.
